- Cancel or reschedule free of charge until 7 days before the session; later rules apply in article 7.
- Mixing and mastering include 2 revision rounds by default; extra work is quoted separately.
- We keep session files for 24 months; see also the privacy policy and disclaimer.
1. Scope and parties
These terms and conditions apply to all agreements between Peonscale B.V., Van Ostadestraat 184, 1073 TS Amsterdam (KvK 87793067, VAT NL885537890B01), and you as client, for studio services under the trade name Peonscale.
They sit alongside our legal notice, and where relevant the privacy policy, cookie policy and any data processing agreement. If a signed quote conflicts with these terms, the quote prevails for that project unless mandatory consumer law says otherwise.
Your purchase terms are rejected unless we accept them in writing.
2. Definitions
| Term | Meaning |
|---|---|
| Consumer | A natural person acting outside trade or profession. |
| Business client | A legal entity or person acting in trade or profession. |
| Quote | Our written offer describing the service, date, price with and without VAT, deposit and any specifics. |
| Session | The reserved studio time block or agreed remote work for mix or master. |
| Deliverables | Audio files and other results we deliver under the quote. |
| Business day | Monday through Friday, excluding public holidays in the Netherlands. |
3. Formation of the contract
Requests via contact, phone or email are non-binding. We usually send a quote within 2 business days. The contract is formed when you accept the quote in writing (email is enough) and we receive the deposit under article 6. Until then a hold on the calendar is non-binding.
For distance contracts we confirm the booking on a durable medium with the essential quote details, in line with Dutch law and EU consumer rules.
4. Services, prices and VAT
Services include Vocal and spoken-word recording, Band and session recording, Mixing, Mastering and Podcast and interview recording as described on the site and in your quote. Indicative rates on services — for example €109 per hour for vocals or €1,195 for a band day — include 21% VAT unless stated otherwise; ex-VAT amounts such as €90.08 are shown where useful for business clients.
The quoted amount prevails. Extra work (additional hours, tracks, stems, rush delivery) is invoiced only with your written approval. All amounts are in euros.
5. Performance and scheduling
Studio hours: Monday–Friday 10:00–19:00, Saturday 11:00–17:00, closed on Sunday.. Sessions are scheduled within those hours unless the quote covers evening or weekend work. Up to 6 musicians may play together in the live room; larger setups need prior agreement via contact.
Preparation guides are in our guides, e.g. vocal warm-up or band planning. Delay caused by incomplete material may shorten the session without refund unless we caused the delay.
6. Deposit, invoicing and payment
When you confirm a quote you pay a 30% deposit of the agreed total including VAT. The deposit is offset against the final invoice.
Consumers pay the balance on the session day or when deliverables are handed over for remote work. Business clients pay within 14 days of invoice date unless the quote states otherwise. Payment by bank transfer; card payment in the studio when we confirm it in advance.
Late payment may incur statutory commercial interest and reasonable collection costs. Until full payment we may withhold final masters; session archives follow article 11.
7. Cancellation and rescheduling by you
| Timing | Effect |
|---|---|
| More than 7 days before the session | Free cancellation or reschedule; deposit refunded within 14 days if you cancel. |
| Within 7 days down to 72 hours | Deposit credited once toward a new date within 3 months; otherwise forfeited. |
| Under 72 hours or no-show | Deposit and any remaining session fee remain due unless you prove force majeure. |
Send requests in writing to [email protected]. These rules do not limit statutory withdrawal rights where they apply (article 8).
8. Withdrawal (consumers, distance contracts)
As a consumer you may have 14 days to withdraw after a distance contract without giving reasons, under Dutch civil code and EU consumer rules.
If you ask us to start before that period ends, you may owe a proportionate amount for work already done if you withdraw. Withdrawal expires for services fully performed within the period after your express consent to start and acknowledgment that you lose the right once performance is complete. Custom audio produced specifically for you may be excluded where the law allows.
Notify withdrawal via [email protected] with your name, quote date and service. We refund within 14 days using the same payment method unless agreed otherwise.
9. Cancellation by Peonscale
If we must cancel (equipment failure, engineer illness, incident on premises) we notify you promptly and offer another date. If that does not work we refund all payments for that session within 14 days. We do not swap engineers without consent when the quote names someone.
10. Studio conduct and minimum age
Treat gear and rooms carefully and follow staff instructions. No smoking or vaping on premises. Minimum age for participants is 16; younger artists only with written parental consent, booking and payment by the guardian, and an adult present throughout.
We may stop a session for dangerous behaviour, serious disruption or third-party copyright breaches; the reserved time remains due. Damage to studio property through intent or gross negligence is charged to you.
11. Revisions, delivery and archive
Mixing and mastering each include 2 revision rounds as on mixing and mastering. A round is one bundled list of notes processed in one pass. Extra rounds or a new artistic direction after approval are quoted separately.
Unless the quote says otherwise we deliver stereo 24-bit WAV via download link. We keep session and project files for 24 months after last project activity, then delete unless longer storage is agreed in writing. You remain responsible for backups; see delivering stems.
12. Intellectual property and rights
Your works. Music and material you supply stay yours. You warrant necessary rights and indemnify us against third-party claims.
Recordings. After full payment Peonscale B.V. grants the usage rights described in the quote. We may use anonymous technical references internally, not public portfolio pieces without your written consent.
AI and voice. We do not train models on your recordings or create voice clones without written consent from the person concerned.
13. Liability
We perform services with professional studio care. Artistic outcomes also depend on your preparation and choices; we do not guarantee commercial success.
Liability is limited to direct damage from attributable breach, except for intent, wilful recklessness or personal injury. For business clients total liability per assignment is capped at that invoice amount unless mandatory law provides otherwise. Website information is covered by the disclaimer, not these terms.
14. Force majeure
Neither party is liable for failure caused by force majeure beyond reasonable control (power loss, network outage, government measures, serious illness). Obligations are suspended while it lasts. Parties agree a new date; if performance remains impossible for more than 30 days either party may terminate with refund of prepaid amounts for unperformed services.
15. Personal data
We process personal data under the privacy policy. Contact forms may route through FormSubmit (possible transfer outside the EEA). Business clients sometimes process artist data; the data processing agreement may then apply.
16. Complaints, disputes and governing law
Report session complaints within 14 days of delivery in writing with details; we respond with a proposed remedy within a reasonable time. Parties try to resolve disputes amicably first.
Dutch law applies. Consumers resident in the Netherlands may rely on mandatory consumer protections. Disputes go to the competent court in the Amsterdam district unless mandatory law designates another forum.
17. Changes
We may update these terms. The version on peonscale.digital dated 16 October 2026 applies to new bookings after publication. Ongoing projects stay on the terms of the quote date unless we agree otherwise in writing. Last editorial update: 16 October 2026.
